Overview
Lyndsey represents companies and business owners in high stakes intellectual property and complex commercial disputes, with a practice centered on protecting brands, technology, and competitive advantage. She litigates matters involving trade secrets, trademarks, copyright, patents, counterfeiting, unfair competition, employee fraud, and intellectual property theft, and she regularly advises clients on practical, effective enforcement strategies to stop infringement and misuse before it escalates.
Lyndsey works with clients across a wide range of industries, including enterprise and networking technology, consumer electronics, wearable technology, internet service providers, textile and industrial manufacturing, securities, and financial payments technology. She handles cases from first filing through appeal. Lyndsey has tried bench and jury cases in both state and federal courts in California and New York and has handled appeals before the Ninth and Second Circuits. In addition to intellectual property litigation, she prosecutes and defends complex commercial cases involving high exposure and sophisticated legal issues.
- Shared first chair responsibilities at trial in San Francisco Superior Court representing one of three co-founders of an early-entry bitcoin exchange handling competing breach of fiduciary duty and fraud claims related to $250 million worth of bitcoin holdings.
- Obtained key preliminary injunction leading to eventual favorable global settlement of two related matters (one pending in Northern District of California, the other in the Eastern District of Texas) representing Fortune 50 Company in a trademark infringement case against a reseller, in a case seeking approx. $80 million for various claims.
- Represented beverage distribution company in a breach of fiduciary duty matter between minority and majority shareholders pending in Alameda County Superior Court relating to the Company’s sale of its assets for $245 million in 2020.
- Represented Real Estate Development Company in a tortious interference with economic advantage action pending in Marin County Superior Court relating to the development of a $20 million property and its sale.
- Lead counsel in numerous federal court matters consisting of a mix of trademark infringement, unfair competition, trade secret misappropriation, and fraud claims on behalf of Fortune 100 technology client in California, Texas, and New York District Courts.
- Co-lead counsel on a matter pending in the Northern District of California relating to the pirating of approximately $50 million of software licenses including copyright infringement and DMCA violations.
